Viele Grill-Fans und auch wir von Santos nutzen die Chance zum Abgrillen. Allerdings ist nicht jeder ein Freund von Grill, Holzkohle und dem typischen Grillaroma. Besonders schwer haben es <strong>Mieter,<\/strong> die beim Grillen <strong>viele Regeln<\/strong> beachten m\u00fcssen.<\/p>\n<p>Aber \u2013 und jetzt kommen wir zur positiven Nachricht \u2013 das <strong>Amtsgericht Berlin-Wedding hat 1990<\/strong> geurteilt, dass ein <strong>Holzkohlegrill<\/strong> in einem <strong>Mietergarten betrieben<\/strong> werden darf. Dies <strong>gilt<\/strong> selbst dann, wenn der <strong>Vermieter<\/strong> das Grillen auf dem Balkon oder der Terrasse der Mietsache <strong>verboten<\/strong> hat.<\/p>\n<h2>Garten nicht mit Balkon oder Terrasse vergleichbar<\/h2>\n<p>In der verhandelten Sache (Az: 10\u00a0C\u00a0476\/89) ging es um einen Streit zwischen einem Mieter und dessen Vermieter. Der Mieter hatte mehrfach im Mietergarten gegrillt, Laut Hausordnung war zwar das Grillen auf dem Balkon bzw. der Terrasse verboten. Aber f\u00fcr den <strong>Garten<\/strong> fehlte eine klare Regelung. Als der Vermieter die Benutzung des Grills untersagte, zog der Mieter vor Gericht \u2013 und bekam <strong>Recht.<\/strong><\/p>\n<p><!--wpads#content--><!--wpads#content1--><!--wpads#content2--><\/p>\n<p>F\u00fcr das Amtsgericht war unter anderem das Fehlen einer Regelung f\u00fcr den Mietergarten ausschlaggebend. Dar\u00fcber hinaus ist in den Augen der Richter der <strong>Garten kein Mietgegenstand<\/strong>, der \u00e4hnlich dem Balkon oder der Terrasse unmittelbar in die Wohnung integriert ist. Das <strong>Grillen<\/strong> im <strong>Garten<\/strong> geh\u00f6re daher nach Meinung des <strong>AG Berlin-Wedding zum Gebrauch der Mietsache.<\/strong><\/p>\n<p>Aber \u2013 und in diesem Punkt verwies das Gericht auf Einschr\u00e4nkungen \u2013 es darf durch das <strong>Grillen nicht<\/strong> zu einer <strong>erheblichen<\/strong> und <strong>unzumutbaren Beeintr\u00e4chtigung<\/strong> der <strong>Nachbarn<\/strong> kommen.<\/p>\n<blockquote><p>Unser Tipp: In Mietvertrag und Hausordnung kann die Benutzung von Holzkohle- und Gasgrill verboten sein.
