Ein <strong>Urteil<\/strong> des <strong>Amtsgerichtes<\/strong> Bonn bl\u00e4st frischen Wind in die Segel.<\/p>\n<h2>Grillen auf dem Balkon oder Terrasse \u2013 1 x im Monat ist OK<\/h2>\n<p>Der Fall, der zu dem Urteil f\u00fchrte, sah folgenderma\u00dfen aus. Eine Familie aus einem <strong>Mehrfamilienhaus,<\/strong> die das <strong>Dachgeschoss<\/strong> bewohnte, k\u00fcrzte auf eigene Faust die Miete, da sie sich durch das Grillen der anderen Mieter in ihrem Mietgebrauch <strong>eingeschr\u00e4nkt<\/strong> sah. Aufgrund der fehlenden Miete klagte der <strong>Vermieter<\/strong> vor Gericht nach einer <strong>Nachzahlung,<\/strong> die <strong>Familie<\/strong> forderte als Gegenleistung das <strong>Grillen<\/strong> mit fossilen Brennstoffen (Holzkohle oder Steinkohle) zu <strong>verbieten.<\/strong><\/p>\n<p><!--wpads#content--><!--wpads#content1--><!--wpads#content2--><\/p>\n<p>Die Richter entschieden jedoch teilweise im Sinn der <strong>Kl\u00e4ger.<\/strong> Da diese nur einen <strong>\u201eEinwirkungsanspruch\u201c<\/strong> haben, h\u00e4tten sie den Vermieter lediglich darauf hinweisen d\u00fcrfen, auf die anderen Mieter <strong>\u201eeinzuwirken\u201c,<\/strong> nicht aber auf eigene Faust die Miete k\u00fcrzen. Im Weiteren wird allerdings auch festgehalten, dass Grillen mittlerweile sozial anerkannt sei, auch in urbanen Gebieten, k\u00f6nne das Grillen somit nicht untersagt werden. Das Urteil: 1 x im Monat ist das Grillen auch auf dem <strong>Balkon<\/strong> oder der <strong>Terrasse erlaubt,<\/strong> die Nachbarn m\u00fcssen aber 48 Stunden vorher informiert werden.<\/p>\n<h2>Artikel 2 Grundgesetz nicht au\u00dfer Kraft gesetzt<\/h2>\n<p>Die <strong>Mitmieter<\/strong> k\u00f6nnen sich auf den <strong>Artikel 2 des Grundgesetzes<\/strong> berufen, freie <strong>Entfaltung<\/strong> der <strong>Pers\u00f6nlichkeit.<\/strong> Auf der anderen Seite haben die <strong>Kl\u00e4ger<\/strong> aber das <strong>Recht<\/strong> auf <strong>ungest\u00f6rten Mietgebrauch<\/strong>, was eine genaue Abw\u00e4gung bedarf.
