Dass <strong>85 Prozent<\/strong> aller Deutschen gern zum Grill greifen, hei\u00dft aber noch lange nicht, dass diese automatisch Recht haben. Speziell beim Grillen auf <strong>Balkon<\/strong> oder <strong>Terrasse<\/strong> ist \u00c4rger in aller Regel nicht sehr weit. Wir haben uns in der Urteilsecke wieder einmal umgesehen.<\/p>\n<p>Und sind beim<strong> Landgericht Essen<\/strong> f\u00fcndig geworden. Das Urteil stammt aus dem Jahr 2002 und befasst sich mit einem Thema, dass nach wie vor eine gewisse Brisanz genie\u00dft \u2013 dem Grillen auf dem Balkon als Mieter.<\/p>\n<h2>Grillen auf dem Balkon \u2013 K\u00fcndigung gerechtfertigt<\/h2>\n<p>Der Streitgegenstand war \u2013 wie so oft \u2013 der<strong> Grill des Mieters.<\/strong> Allerdings zog diesmal nicht ein Nachbar vor Gericht, sondern der <strong>Vermieter<\/strong> des Grill-Fans. Der hatte n\u00e4mlich in der Hausordnung ein generelles <strong>Grillverbot<\/strong> ausgesprochen. Allerdings hielt sich der Mieter nicht an diese, sondern grillte munter weiter.<\/p>\n<p><!--wpads#content--><!--wpads#content1--><!--wpads#content2--><\/p>\n<p>Die Folge: Nach <strong>mehreren Abmahnungen<\/strong> durch den Vermieter kam es zum bitteren Ende, der <strong>K\u00fcndigung.<\/strong> Die Richter (Az. 10 S 438\/01) des LG Essen sahen diese \u00fcbrigens als <strong>gerechtfertigt<\/strong> an und gaben dem Vermieter Recht. F\u00fcr den Urteilsspruch unerheblich war \u00fcbrigens die Tatsache, ob der Mieter mit <strong>Holzkohle-<\/strong> oder <strong>Elektrogrill<\/strong> seiner Leidenschaft nachging.<\/p>\n<p>Welche Lehre l\u00e4sst sich aus diesem und \u00e4hnlichen Urteilen ziehen?
