Allerdings <strong>nicht<\/strong> immer zur <strong>Freude<\/strong> der <strong>Nachbarn.<\/strong> Leider f\u00fchrt das Grillen immer wieder zu handfesten <strong>Streitigkeiten,<\/strong> die auch vorm <strong>Richter<\/strong> enden.<\/p>\n<p>Heraus kommen unz\u00e4hlige Gerichtsurteile, die Grill-Fans in Deutschland teils enge Grenzen setzen. Was m\u00fcsst Ihr beim Grillen <strong>beachten?<\/strong> Und wann hat Euer Nachbar mit seiner Beanstandung recht? Wir haben einige <strong>Urteile<\/strong> zusammengesucht, die f\u00fcr Euch relevant sein k\u00f6nnten und auch aus der Rubrik \u201eUnbekannt\u201c stammen.<\/p>\n<h2>Aluschalen als Rauch-Pr\u00e4vention<\/h2>\n<p>Eingefleischte Grill-Fans setzen auf <strong>Holzkohle,<\/strong> Rauch und urigen Geschmack. Leider sieht nicht jeder Nachbar diese <strong>Begleiterscheinungen<\/strong> gern. Daher ist der Verursacher angehalten, entsprechende Gegenma\u00dfnahmen zu ergreifen \u2013 wie den Einsatz von <strong>Elektrogrills, Grillpfannen<\/strong> oder <strong>Aluschalen.<\/strong><\/p>\n<p><!--wpads#content--><!--wpads#content1--><!--wpads#content2--><\/p>\n<p>Dieser Ansicht war zumindest das <strong>Landgericht Stuttgart<\/strong> im August 1996 (Az.: 10 T 359\/96), dessen Urteil im Zusammenhang mit dem Streit zweier Wohnungseigent\u00fcmer stand. Tipp: Das LG Stuttgart wies die Klage \u00fcbrigens ab, dreimaliges Grillen f\u00e4llt nach Ansicht der Richter unter die Toleranzgrenze.<\/p>\n<h2>Ruhest\u00f6rung durch Grillabende<\/h2>\n<p>Wer nicht allein grillt, ist meistens etwas <strong>lauter.<\/strong> Allerdings sollte das Grillen in diesem Zusammenhang Grenzen haben. Andernfalls kann es sein, dass Richter dem Verursacher der <strong>Ruhest\u00f6rung<\/strong> Einschr\u00e4nkungen auferlegen \u2013 so geschehen vor dem <strong>OLG Oldenburg<\/strong> (Az.: 13 U 53\/02).<\/p>\n<p>Die Richter sahen ein viermaliges Grillen bis 24 Uhr als \u201esozialad\u00e4quat\u201c an. An allen anderen Abenden muss der Nachbar Ger\u00fcche und Ger\u00e4usche nach 22 Uhr nicht mehr hinnehmen. Ausl\u00f6ser dieses Rechtsstreits war das mehrfache Grillen \u00fcber diesen Zeitrahmen hinaus.<\/p>\n<h2>Wenn\u00b4s qualmt, ist Schluss<\/h2>\n<p>Was tun, wenn der Grill nach dem Anfeuern wundersch\u00f6n vor sich <strong>hinqualmt<\/strong> und dem Nachbarn wie eine Nebelkerze die Sicht nimmt? Dann ist Schluss mit dem Grillen \u2013 zumindest nach Ansicht des <strong>OLG D\u00fcsseldorf.
